FixVibe એ EGO HERO LLC («FixVibe», «અમે», «અમને», «અમારું») દ્વારા સંચાલિત Dynamic Application Security Testing (DAST) સેવા છે. Account બનાવવાથી, sign in કરવાથી, અથવા anonymous scan ચલાવવાથી, તમે («તમે», «Customer») આ Terms, અમારી Acceptable Use Policy, અમારી Disclaimer, અને અમારી Privacy Policy સાથે સંમત થાઓ છો. જો તમે ઉપરોક્ત બધું સ્વીકારતા ન હો, તો FixVibe નો ઉપયોગ ન કરો.

FixVibe વાપરવા માટે તમારી ઉંમર ઓછામાં ઓછી 16 વર્ષ હોવી જોઈએ. જો તમે કોઈ organizationની તરફથી FixVibe વાપરો છો, તો તમે દર્શાવો અને warrant કરો છો કે તે organizationને આ Termsથી બાંધવાની authority તમારી પાસે છે.

Active scans perform bounded verification against your application. In rare cases, that testing can cause unexpected behavior including slow responses, error spikes, partial outages, or test data being written to production stores. By running an active scan you acknowledge and accept these risks. We recommend running active scans against staging environments where possible.

તમે અમને test કરવા માટે authorize કરેલા system સામે active scan ચલાવવાથી revenue, data, customers, અથવા goodwillની કોઈપણ loss થાય તો FixVibe જવાબદાર નથી.

Scheduled re-scans. જો તમે verified domain પર recurring schedule enable કરો છો (Pro / Unlimited only), તો દરેક cron-triggered scan domain ownership પ્રથમ verify કરતી વખતે અને scan શરૂ કરતી વખતે આપેલી authorization-to-scan attestation inherit કરે છે. Schedule enable હોય ત્યાં સુધી attestation રહે છે. તમે ડેશબોર્ડ → ડોમેઇન્સ પર schedule disable કરીને ક્યારે પણ revoke કરી શકો છો; next cron tick domain skip કરશે.

Paid plans Stripe દ્વારા monthly અથવા annually bill થાય છે. Subscriptions renewal date પહેલાં cancel ન કરો તો automatically renew થાય છે. તમે એકાઉન્ટ → બિલિંગમાંથી ક્યારે પણ cancel કરી શકો છો; તમે ચૂકવેલા periodના અંત સુધી તમારો access ચાલુ રહે છે.

Mandatory consumer-protection law જ્યાં જરૂરી કરે તે સિવાય fees non-refundable છે. EU અને UK consumers સ્વીકારે છે કે FixVibe digital service છે જે scan submission થતાં જ benefits આપવાનું શરૂ કરે છે, અને scan ચલાવીને અથવા paid features વાપરવાનું અન્યથા શરૂ કરીને તેઓ cooling-off period દરમિયાન service performance શરૂ કરવા express request કરે છે અને EU Directive 2011/83/EU Article 16(m) હેઠળ withdraw કરવાનો right waive કરે છે. Pricing, plan limits, અને feature availability બદલાઈ શકે છે. Active paid plansને અસર કરતા material changes ઓછામાં ઓછા 30 days' notice સાથે જાહેર કરવામાં આવશે.

GitHub-integrated scans. જો તમે optional GitHub integration (Pro અને Unlimited plans) connect કરો અને repo scan ચલાવો, તો અમે તમારા stored OAuth tokenનો ઉપયોગ કરીને GitHub REST API મારફતે repository content fetch કરીએ છીએ. Findings બનાવવા source content memoryમાં process થાય છે; અમે surface કરેલી individual finding evidence જ persist થાય છે, અને ordinary scans જેટલી જ retention window માટે. અમે full source dumps long-term storageમાં ક્યારેય લખતા નથી અને repository contentનો ઉપયોગ AI models train કરવા માટે ક્યારેય કરતા નથી. અમે high availability માટે પ્રયત્ન કરીએ છીએ, પરંતુ અલગ written service-level agreement ન હોય ત્યાં સુધી uptime guarantee આપતા નથી. Hobby-tier features notice વગર બદલાઈ અથવા discontinue થઈ શકે છે. Paid features ઓછામાં ઓછા 30 days' notice વિના discontinue નહીં થાય.

જો તમે United Statesના resident છો, તમે અને EGO HERO LLC સંમત છો કે આ Terms અથવા FixVibeમાંથી ઊભો થતો અથવા સંબંધિત કોઈ dispute, claim, અથવા controversy (દરેક, «Dispute») American Arbitration Association («AAA») દ્વારા તેની Consumer Arbitration Rules હેઠળ administered binding individual arbitrationથી resolve થશે. Arbitration English languageમાં, amount in controversy USD 25,000થી ઓછું હોય ત્યારે documents-only basis પર (અથવા અન્યથા remotely), અને Cheyenne, Wyomingમાં seated રહેશે. Award પર judgment કોઈ competent jurisdictionના courtમાં entered થઈ શકે છે.

CLASS ACTION WAIVER. તમે અને EGO HERO LLC સંમત છો કે દરેક party બીજી સામે claims ફક્ત individual capacityમાં લાવી શકે છે, અને કોઈ purported class, collective, અથવા representative proceedingમાં plaintiff અથવા class member તરીકે નહીં. ARBITRATOR એકથી વધુ વ્યક્તિના claims consolidate કરી શકશે નહીં અને કોઈ representative અથવા class proceedingના સ્વરૂપની અધ્યક્ષતા કરી શકશે નહીં.

30-day opt-out. તમે આ arbitration agreement અને class waiverમાંથી opt out કરી શકો છો, પ્રથમ વખત આ Terms accept કર્યા પછી 30 daysની અંદર support@fixvibe.app પર written notice મોકલીને. Noticeમાં તમારું નામ, account email, અને તમે arbitrationમાંથી opt out કરો છો તે જણાવવું જરૂરી છે. Opting out આ Termsની કોઈ અન્ય provisionને affect કરતું નથી.

કોઈપણ party તે courtની jurisdictionમાં આવતા disputes માટે small-claims courtમાં individual action લાવી શકે છે, અને intellectual property infringement અથવા FixVibe સુધી unauthorized access માટે courtમાં injunctive અથવા અન્ય equitable relief માગી શકે છે.

જો આ Section 16નો કોઈ ભાગ unenforceable માનવામાં આવે, તો remainder permitted maximum extent સુધી enforced રહેશે; જો class action waiver પોતે unenforceable માનવામાં આવે, તો entire arbitration agreement affected dispute બાબતે void રહેશે અને litigation Section 15માં identified courtsમાં આગળ વધશે.

European Union, United Kingdom, અથવા અન્ય કોઈ jurisdictionમાં ordinarily resident consumers, whose mandatory law grants them the right to bring claims in their home courts, તે right રાખે છે. Section 16માં arbitration agreement અને class action waiver આવા consumersને ત્યાં સુધી લાગુ પડતા નથી જ્યાં સુધી તેઓ mandatory local consumer protections સાથે conflict કરે.

Scan reports third-party hostname identify કરી શકે છે અને તે security weaknesses ધરાવે છે એવો assertion કરી શકે છે. કારણ કે અમારા findings heuristic છે અને false positives સામેલ હોઈ શકે છે, તમે સંમત છો કે તમે FixVibe scan report અથવા screenshot જે તમે own અથવા operate ન કરતા target hostnameને identify કરે છે તેને publicly post, social media પર share, અથવા general publicને otherwise available નહીં કરો, પહેલા target operatorની written consent મેળવ્યા વિના.

આ restriction (i) affected operatorને responsible disclosure, (ii) તમે own અથવા operate કરતા systems માટે reports share કરવું, અથવા (iii) target identify ન કરતા redacted summaries share કરવું prohibit કરતી નથી.

અમે સમયાંતરે આ Terms revise કરી શકીએ છીએ. Material changes effective થાય તે પહેલાં ઓછામાં ઓછા 14 days પહેલાં in-app અથવા email દ્વારા announce થશે. Effective date પછી FixVibeનો continued use revised Termsની acceptance ગણાશે. Current version અને effective date આ pageના top પર shown છે.
